SYNOPSIS

     Authorizes certain persons to display American flag on or over certain property of NJTA, SJTA, and DOT; prohibits NJTA, SJTA, and DOT from removing American flag under certain circumstances.

An Act concerning the display of the American flag on or over certain property of the New Jersey Turnpike Authority, South Jersey Transportation Authority, and Department of Transportation, and supplementing Title 27 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Notwithstanding the provisions of any other law, rule, or regulation to the contrary, a law enforcement organization or veterans organization may display an American flag on a bridge or overpass that is on or travels over a roadway under the jurisdiction of the New Jersey Turnpike Authority, provided that the organization provides notice to the authority, the flag is properly maintained by the organization, and the flag is displayed in a manner consistent with the rules and customs deemed the proper manner to display the flag, such as the federal flag code, 4 U.S.C. s.1 et seq., or any other applicable law or guideline. Notwithstanding the provisions of any other law to the contrary, the New Jersey Turnpike Authority shall not remove any American flag that is displayed in accordance with this section.

 

     2.    Notwithstanding the provisions of any other law, rule, or regulation to the contrary, a law enforcement organization or veterans organization may display an American flag on a bridge or overpass that is on or travels over a roadway under the jurisdiction of the South Jersey Transportation Authority, provided that the organization provides notice to the authority, the flag is properly maintained by the organization, and the flag is displayed in a manner consistent with the rules and customs deemed the proper manner to display the flag, such as the federal flag code, 4 U.S.C. s.1 et seq., or any other applicable law or guideline.  Notwithstanding the provisions of any other law to the contrary, the South Jersey Transportation Authority shall not remove any American flag that is displayed in accordance with this section

 

     3.    Notwithstanding the provisions of any other law, rule, or regulation to the contrary, a law enforcement organization or veterans organization may display an American flag on a bridge or overpass that is on or travels over a roadway under the jurisdiction of the New Jersey Department of Transportation, provided that the organization provides notice to the department, the flag is properly maintained by the organization, and the flag is displayed in a manner consistent with the rules and customs deemed the proper manner to display the flag, such as the federal flag code, 4 U.S.C. s.1 et seq., or any other applicable law or guideline. Notwithstanding the provisions of any other law to the contrary, the department shall not remove any American flag that is displayed in accordance with this section

 

     4.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill authorizes law enforcement organizations and veterans organizations to display the American flag on a bridge or overpass that is on or travels over a roadway under the jurisdiction of the New Jersey Turnpike Authority (NJTA), South Jersey Transportation Authority (SJTA), and New Jersey Department of Transportation (DOT), provided that the organization provides notice to the appropriate agency, the flag is properly maintained by the organization, and the flag is displayed in a manner consistent with the rules and customs deemed the proper manner to display the flag.  The NJTA, SJTA, and DOT are prohibited from removing any American flag displayed in accordance with the bill.
