SYNOPSIS

     Imposes five-year moratorium on new construction at public institutions of higher education.

An Act concerning construction at public institutions of higher education. 

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  As used in this section, "construction" means new construction and additions, but does not include alterations, improvements, reconstruction, renovations, and repairs.

     b.    Notwithstanding any other provision of law to the contrary, a public institution of higher education shall not enter into a contract for the construction of any building or facility on its campus for a five-year period beginning on the effective date of this act. 

     c.     The Secretary of Higher Education may approve an exemption to the provisions of subsection b. of this section, upon application by a public institution of higher education, for a construction project that:

     (1)  will be funded entirely by private funding;

     (2)  is needed to remedy an emergency condition; or

     (3)   will be used primarily as a health care facility. 

 

     2.  This act shall take effect immediately. 

 

 

STATEMENT

 

     This bill imposes a five-year moratorium on new construction at public institutions of higher education. 

     Under the bill, a public institution of higher education will be prohibited from entering into a contract for the construction of any building or facility on its campus for a five-year period beginning on the bill's effective date.  The bill permits the Secretary of Higher Education to approve an exemption to the moratorium, upon application by a public institution of higher education, for a construction project that:

     (1)  will be funded entirely by private funding;

     (2)  is needed to remedy an emergency condition; or

     (3)   will be used primarily as a health care facility.
