     Establishes certain recording and transmission standards for clinical laboratories.

An Act concerning clinical laboratories and supplementing Title 45 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    As used in this act, "clinical laboratory" means a laboratory licensed by the Department of Health, pursuant to the "New Jersey Clinical Laboratory Improvement Act," P.L.1975, c.166 (C.45:9-42.26 et seq.).

 

     2.    a.  Within 30 days after the effective date of this act, a licensed clinical laboratory, as a condition of continued licensure, shall record and report patient data using a program with features that are equivalent to Health Level Seven International recording and reporting standards if the patient data is reported to a State government entity that requires such data to be reported using Health Level Seven International standards. 

     b.    Within 30 days of the issuance of a new license to a clinical laboratory on or after the effective date of this act, the clinical  laboratory, as a condition of licensure, shall record and report patient data using a program with features that are equivalent to Health Level Seven International recording and reporting standards if the patient data is reported to a State government entity that requires such data to be reported using Health Level Seven International standards. 

 

     3.    The Commissioner of Health shall adopt rules and regulations, in accordance with the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), as are necessary to effectuate the provisions of this act.

 

     4.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill establishes certain recording and transmission standards for clinical laboratories.

     Under the bill, a clinical laboratory, as a condition of licensure, is to record and report patient data using a program with features that are equivalent to Health Level Seven International recording and reporting standards if the patient data is reported to a State government entity that requires such data to be reported using Health Level Seven International standards.

     Health Level Seven International standards are standards for the exchange of electronic health care data.
