SYNOPSIS

     Requires employers to adopt domestic violence policies and protocols established by DOLWD.

An Act concerning domestic violence in the workplace and supplementing Title 34 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  The Commissioner of Labor and Workforce Development, in consultation with the Advisory Council on Domestic Violence established pursuant to P.L.1979, c.337 (C.30:14-1 et seq.), shall develop culturally competent workplace policies and safety protocols concerning workplace responses to domestic violence.  The policies and protocols shall include, but not be limited to:

     (1)   training standards and information for all employees;

     (2)   procedures for responding to employees impacted by domestic violence;

     (3)   strategies for the education of employees on bystander intervention; and

     (4)   information concerning resources for victims of domestic violence.

     The policies and safety protocols shall be posted, in a printable format, on the Internet website of the Department of Labor and Workforce Development.

     b.    Within one year of the date of enactment of P.L.     , c.          

(C.        ) (pending before the Legislature as this bill), all employers shall adopt written domestic violence policies and safety protocols in accordance with the policies and protocols established by the commissioner pursuant subsection a. of this section.

     c.     All employers shall disseminate the domestic violence policies and safety protocols required in subsection a. of this section at least once annually to all employees.

 

     2.    This act shall take effect on the first day of the fourth month next following the date of enactment.

 

 

STATEMENT

 

     This bill requires all employers in this State to adopt domestic violence policies and protocols established by the Department of Labor and Workforce Development. 

     Under the bill, the Commissioner of Labor and Workforce Development, in consultation with the Advisory Council on Domestic Violence, is required to develop culturally competent workplace policies and safety protocols concerning workplace responses to domestic violence.  The policies and protocols are required to include, but not be limited to: training standards and information for all employees; procedures for employers to respond to employees impacted by domestic violence; strategies for the education of employees on bystander intervention; and information concerning resources for victims of domestic violence. The policies and safety protocols are required to be posted on the website of the department.

     The bill requires all employers in this State to adopt written domestic violence policies and safety protocols in accordance with the policies and protocols established by the commissioner within one year of the effective date of the bill. The employers are required to disseminate the policies and protocols to employees at least once each year.
