SYNOPSIS
Prohibits location of off-road vehicle training or recreation facility within five miles of residential zone.

An Act concerning the location of off-road vehicle training or recreation facilities and amending P.L.1953, c.174.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Section 1 of P.L.1953, c.174 (C.5:7-8) is amended to read as follows:
1. a. No person shall operate or conduct any motor vehicle races or exhibitions of motor vehicle driving skill, or any track or other place for the holding of such races or exhibitions, unless a license to operate and conduct the same shall be first obtained from the Department of Law and Public Safety, which license said department may, in its discretion, issue to any applicant therefor upon compliance with the provisions of this act and the rules and regulations issued pursuant thereto, and the payment of a fee of one hundred dollars ($100.00) in the manner hereinafter provided.
b. No person shall operate an off-road training or recreation facility for motocross bikes, all-terrain vehicles, or both, unless a license to operate the facility shall be first obtained from the Department of Law and Public Safety. The department shall adopt rules and regulations as it deems appropriate for the location and operation of an off-road training or recreation facility. The department shall not issue a license for the location and operation of an off-road training or recreation facility located within five miles of an area zoned for residential purposes.

2. This act shall take effect immediately.
STATEMENT
This bill would require a person interested in operating an off-road training or recreation facility for motocross bikes, all-terrain vehicles, or both, to obtain a license from the Department of Law and Public Safety prior to operating any such facility. The bill authorizes the department adopt rules and regulations as it deems appropriate for the location and operation of an off-road training or recreation facility. The bill prohibits the department from issuing a license for the location and operation of an off-road training or recreation facility if it would be located within five miles of an area zoned for residential purposes.
