     Prohibits certain examinations of alleged sex crimes victims.

An Act concerning physical examinations of victims of sexual assault and supplementing chapter 61B of Title 2A of the New Jersey Statutes. 

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  a.  The court shall not order or otherwise require the alleged victim in a prosecution for aggravated sexual assault, sexual assault, aggravated sexual contact, sexual contact, and human trafficking involving sexual activity to submit to or undergo a gynecological or physical examination of the breasts, buttocks, anus, or any part of the sexual organs.

     b.  The refusal of an alleged victim to undergo an examination described in subsection a. of this section shall not serve as the basis to exclude evidence obtained from other relevant examinations of the victim. 

 

     2.    This act shall take effect immediately. 

 

 

STATEMENT

 

     This bill provides that in a prosecution for aggravated sexual assault, sexual assault, aggravated sexual contact, sexual contact, and human trafficking involving sexual activity, the court is prohibited from ordering or otherwise requiring the alleged victim to submit to or undergo a gynecological or physical examination of the breasts, buttocks, anus, or any part of the sexual organs.

     Further, the refusal of an alleged victim to undergo an examination is not to serve as the basis to exclude evidence obtained from other relevant examinations of the victim.

     This bill is based upon a New York bill.
