     Establishes program to allow certain motorcycle events to be held in State parks, forests, and wildlife management areas.

An Act concerning certain recreational use on certain State-owned lands and supplementing Title 13 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  The Department of Environmental Protection shall establish a program to allow events sanctioned by the American Motorcyclist Association to be held in State parks, forests, and wildlife management areas. 

     b.    (1) The department may establish conditions, on a site specific basis, to restrict events allowed pursuant to subsection a. of this section in order to protect habitat for species of fauna or flora that are of special concern, rare, threatened, or endangered. 

     (2) An event held pursuant to this section, and any rules or regulations adopted pursuant thereto, shall not be deemed a violation of any deed restriction related to allowable recreational activities on the lands or allowable uses of the lands for recreation and conservation purposes.

     c.     An organization wishing to conduct an event sanctioned by the American Motorcyclist Association shall apply to the department for approval to conduct the event on a form to be prescribed by the department, which shall require, at a minimum, the date, start and end time, location, and proposed route or course for the proposed event.

     d.    No later than one year after the date of enactment of this act, the department shall adopt, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), rules and regulations necessary to establish the program required by this section.  These rules and regulations shall:  seek to minimize any detrimental effects on the environment that may be caused by the event; protect public safety; and require public notice to be provided by the organization holding the event to the local governing body of the municipality in which the property is located and to the public.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill directs the Department of Environmental Protection (DEP) to establish a program to allow events sanctioned by the American Motorcyclist Association (AMA) to be held in State parks, forests, and wildlife management areas.  The bill provides that the DEP may establish conditions, on a site specific basis, to restrict events allowed pursuant to the bill in order to protect habitat for species of fauna or flora that are of special concern, rare, threatened, or endangered.  An organization wishing to conduct an AMA sanctioned event would be required to apply to the DEP for approval. 

     The bill requires the DEP, no later than one year after the bill is enacted into law, to adopt rules and regulations necessary to establish this program.  These rules and regulations would:  seek to minimize any detrimental effects on the environment that may be caused by the event; protect public safety; and require public notice to be provided by the organization holding the event to the local governing body of the municipality in which the property is located and to the public.
