An Act requiring a biennial review of fees charged for the issuance of certain professional and occupational credentials, and supplementing P.L.1974, c.46 (C.45:1-3.1 et seq.)

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  As used in this section:

     "Credential" means a license, certificate of registration, registration, or other similar type of document that allows an individual to practice a specific profession or occupation.

     b.    (1)  Not less than once every two years the Division of Consumer Affairs shall conduct a review of each professional and occupational board and committee it oversees to examine the fees charged for:

     (a)   an initial credential;

     (b)   a credential renewal; and

     (c)   a credential for an applicant with an out-of-state credential.

     (2)   At a time determined by the division, but not less than once every two years, other State agencies that oversee the issuance of a professional or occupational credential pursuant to P.L.1974, c.46 (C.45:1-3.1 et seq.) shall conduct a review of the fees charged to individuals for an initial credential, credential renewal, and a credential for an out-of-State applicant, and submit the findings to the division.

     c.     Upon completion of the review, as required by subsection b. of this section, the division shall assess whether the total amount of fees collected for each of the various credentials exceeds the costs incurred by the boards, committees, and agencies that issue the credentials.  If a fee is determined to be in excess, any adjustment to that fee shall be promulgated by the appropriate board, committee, or agency to take effect for the next credential renewal period.

 

     2.    This act shall take effect on the first day of the twelfth month next following enactment, except the Director of Consumer Affairs may take anticipatory administrative action in advance as shall be necessary for the implementation of this act.

 

 

STATEMENT

 

     This bill requires the Division of Consumer Affairs to conduct a review of the boards and committees it oversees to examine fees charged for initial credentials, credential renewal, and a credential for an out-of-State individual.  Other State agencies that oversee the issuance of a credential pursuant to P.L.1974, c.46 (C.45:1-3.1 et seq.) shall perform the same review of fees and submit findings to the division.  An assessment is to be conducted to determine whether the total amount of fees collected for each of the various credentials total an amount that exceeds the costs incurred by boards, committees, and agencies that issue credentials.  If a fee is determined to be in excess, an adjustment to that fee shall be made before the next renewal period of the credential.  The bill stipulates that this review is to be done by the division and other State agencies at least every two years.
