     Expands exemption to wage and hour requirements for certain summer camp workers.

An Act expanding an exemption to wage and hour requirements for certain summer camp workers and amending P.L.1967, c.89.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 1 of P.L.1967, c.89 (C.34:11-56a4.1) is amended to read as follows:

     1.    a.    The provisions of the [act to which this act is a supplement] "New Jersey State Wage and Hour Law," P.L.1966, c.113 (C.34:11-56a et seq.) in respect to minimum wages and compensation for overtime work shall not be applicable during the months of June, July, August or September of the year to:

     (1)   summer camps, conferences and retreats operated by any nonprofit or religious corporation or association; and

     (2)   employees of private summer camps who are 22 years of age or under and are enrolled in any high school, college or university, or vocational training program in the period immediately preceding employment with the private summer camp.

     b.    The provisions of the "New Jersey State Wage and Hour Law," P.L.1966, c.113 (C.34:11-56a et seq.) in respect to compensation for overtime work shall not be applicable during the months of June, July, August or September of the year to resident summer camps.

     c.     For the purposes of this section:

     "Private summer camp" means a youth camp licensed, and subject to the requirements and penalties provided, under the "New Jersey Youth Camp Safety Act," P.L.1973, c.375 (C.26:12-1 et seq.) and operated by any corporation, company, association, person, or any other entity, except for nonprofit or religious corporations or associations.

     "Resident summer camp" means a private summer camp that as a matter of its business has the children attending the private summer camp stay overnight on a regular basis.

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill expands the current exemption to the wage and overtime requirements of the "New Jersey State Wage and Hour Law," P.L.1966, c.113 (C.34:11-56a et seq.), for nonprofit and religious summer camps to employees of private summer camps who are age 22 or under and enrolled in any high school, college or university, or vocational training program. The bill also expands the exemption to employees of resident summer camps, regardless of the age of the employee, for purposes of compensation for overtime work.

     Currently, the "New Jersey State Wage and Hour Law" provides an exemption to wage and overtime requirements during the months of June, July, August, and September of each year to summer camps, as well as conferences and retreats, operated by any nonprofit or religious corporation or association.

     The bill expands the current exemption for summer camps operated by nonprofit and religious groups to certain employees of private summer camps. The bill defines "private summer camp" as a youth camp licensed, and subject to the requirements and penalties provided, under the "New Jersey Youth Camp Safety Act," P.L.1973, c.375 (C.26:12-1 et seq.) and operated by any corporation, company, association, person, or any other entity, except for nonprofit and religious groups. The bill also defines "resident summer camp" as any private summer camp that as a matter of its business has the children attending the private summer camp stay overnight on a regular basis.
