SYNOPSIS

     Requires BPU to adopt energy efficiency standards for general service incandescent lamps equivalent to federal standards.

An Act concerning energy efficiency standards for general service incandescent lamps and supplementing P.L.2005, c.42 (C.48:3-99 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  No later than one year after the effective date of P.L.    , c.    (C.      ) (pending before the Legislature as this bill), the Board of Public Utilities shall adopt rules and regulations that establish minimum energy efficiency standards for general service incandescent lamps that conform to the federal standards adopted pursuant to 42 U.S.C. s.6295, or any successor legislation.

     b.  Upon the revision of any federal energy efficiency standard for general service incandescent lamps, the Board of Public Utilities shall amend any rules or regulations that establish energy efficiency standards for general service incandescent lamps to conform to the revised federal energy efficiency standard.  Any revision to the State standard shall be effective as of the effective date of the revised federal standard.

     c.  A violation of the rules and regulations adopted pursuant to this section shall be considered a violation of P.L.2005, c.42 (C.48:3-99 et seq.) and shall be subject to the same penalties and enforcement measures provided therein.

     d.  As used in this section, "general service incandescent lamp" means the same as that term is defined in 42 U.S.C. s.6295, or any successor legislation. 

 

     2.    This act shall take effect immediately. 

 

 

STATEMENT

 

     This bill would require the Board of Public Utilities (BPU) to adopt energy efficiency standards for general service incandescent lamps equivalent to federal standards. 

     The bill would require that the BPU adopt rules and regulations that establish minimum energy efficiency standards for general service incandescent lamps that conform to the federal standards adopted pursuant to 42 U.S.C. s.6295, or any successor legislation.  Upon the revision of any federal energy efficiency standard for general service incandescent lamps, the BPU would be required to amend any energy efficiency standard for general service incandescent lamps to conform to the revised federal energy efficiency standard.  Any revised State standard would be effective as of the effective date of the revised federal standard.  A violation of the provisions in the bill would be considered a violation of P.L.2005, c.42 (C.48:3-99 et seq.) and would be subject to the same penalties and enforcement measures, which include a warning for a first violation and a civil penalty of not more than $250 for repeat violations.  As used in the bill, "general service incandescent lamp" means the same as that term is defined in 42 U.S.C. s.6295, or any successor legislation.

     Although states are preempted from enacting energy efficiency standards for certain general service incandescent lamps that are stricter than federal standards, states may adopt energy efficiency standards for general service incandescent lamps that conform to the federal standards and effective dates.  This bill would require BPU to adopt energy efficiency standards for general service incandescent lamps equivalent to federal standards, and would allow BPU to enforce those standards.
