     Prohibits home-schooling of children under DCPP care, custody, or supervision without DCPP approval.

An Act concerning children and supplementing chapter 38 of Title 18A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Notwithstanding any provision of law to the contrary, any child under the care, custody, or supervision of the Division of  Child Protection and Permanency in the Department of Children and Families, including a child placed in a resource family home or in a kinship care home, shall not be home-schooled and shall be enrolled in a public or nonpublic school, unless the division approves the child's home-schooling.

     b.    As used in this section, "kinship care home" means a private residence in which board, lodging, care, and temporary out-of-home placement services are provided to a child by a person who is not the parent of the child but is related to the child through blood, marriage, civil union, domestic partnership, adoption, or is connected to the child or the child's parent by an established positive psychological or emotional relationship.

 

     2.    The State Board of Education, in consultation with the Department of Children and Families, shall adopt rules and regulations pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), which are necessary to carry out the provisions of this act.

 

     3.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill provides that a child under the care, custody, or supervision of the Division of Child Protection and Permanency (DCPP) in the Department of Children and Families, including a child placed in a resource family or kinship care home, may not be home-schooled unless DCPP approves the child's home-schooling.
