SYNOPSIS

     Establishes third degree crime of "stealthing": removing sexually protective device during sexual activity without sexual partner's consent.

An Act concerning certain sexual activity and supplementing Title 2C of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a. A person who, before or during an act of sexual penetration, knowingly removes or damages a sexually protective device without the consent of the person's sexual partner is guilty of a crime of the third degree.

     b.    As used in this act, "sexually protective device" means a physical device intended to prevent pregnancy or sexually transmitted infection.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would make it a crime of the third degree to commit the act of "stealthing": removing or damaging a sexually protective device before or during an act of sexual penetration without the consent of the person's sexual partner.

     The bill defines a "sexually protective device" as a physical device intended to prevent pregnancy or sexually transmitted infection.

     A crime of the third degree is generally punishable by a term of imprisonment of three to five years or a fine of up to $15,000, or both.
