SYNOPSIS

     Prohibits public institutions of higher education from hiring governmental affairs agents.

An Act prohibiting public institutions of higher education from hiring governmental affairs agents and supplementing chapter 3B of Title 18A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Except as otherwise provided in subsections b. and c. of this section, a public institution of higher education shall not enter into a contract for the services of a governmental affairs agent, which include influencing State or federal legislation, regulations, or governmental processes.

     b.    The provisions of subsection a. of this section shall not apply to a governmental affairs agent who is a regular, full-time employee of a public institution performing services for his employer.

     c.     The provisions of subsection a. of this section shall not apply to funds paid to a nonprofit entity or professional association that employs governmental affairs agents including, but not limited to, dues paid by a public institution of higher education to the New Jersey Council of County Colleges pursuant to section 9 of P.L. 1989, c.141 (C.18A:64A-28.5) or to the New Jersey Association of State Colleges and Universities pursuant to section 7 of P.L.1985, c.161 (C.18A:64-51).

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill prohibits a public institution of higher education from entering into a contract for the services of a governmental affairs agent, which include influencing State of federal legislation, regulations, or governmental processes.  The bill will not apply to a governmental affairs agent who is a regular, full-time employee of the public institution performing services for his employer.  Finally, the bill will not apply to funds paid to a nonprofit entity or professional association that employs governmental affairs agents.
