SYNOPSIS

     Requires bidders on certain State contracts to disclose and Department of Treasury to publish certain gender wage information.

An Act concerning public bidding for State contracts and gender wage information and supplementing Title 52 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.     Notwithstanding the provisions of any law, rule or regulation to the contrary, whenever a purchase, contract or agreement is to be made, negotiated or awarded after public bidding pursuant to the provisions of P.L.1954, c.48 (C.52:34-6 et seq.), each bid on the purchase, contract or agreement shall be accompanied by a disclosure of information related to the wage and gender of each of the employees of the bidder, in the form and manner specified by the Director of the Division of Purchase and Property in the Department of the Treasury pursuant to subsection b. of this section.

     b.    The Director of the Division of Purchase and Property shall promulgate forms for the submission of employee wage and gender information required pursuant to subsection a. of this section.  The director shall create forms which will elicit sufficient information in the proper format for the director to determine the gender wage differential of the employees of the bidder.

     c.     The Department of Treasury shall annually publish on its website a list of the gender wage differential information collected pursuant to this act.  The names and wages of specific employees collected pursuant to this act shall remain confidential and shall not be published or disclosed.

 

     2.    This act shall take effect on the first day of the third month next following enactment.

 

 

STATEMENT

 

     This bill provides that whenever a purchase, contract or agreement is to be made, negotiated or awarded after public bidding pursuant to the provisions of N.J.S.A.52:34-6 et seq., each bid on the purchase, contract or agreement shall be accompanied by a disclosure of information related to the wage and gender of each of the employees of the bidder, in a form and manner specified by the Director of the Division of Purchase and Property in the Department of the Treasury.

     The bill requires the Director of the Division of Purchase and Property to promulgate forms for the submission of employee wage and gender information.  The bill requires the director to create forms which will elicit sufficient information in the proper format for the director to determine the gender wage differential of the employees of the bidder.

     The bill also requires the Department of Treasury to publish annually on its website a list of the gender wage information collected pursuant to the bill.  The names and wages of specific employees remain confidential under the bill and are not to be published or disclosed.
