     Exempts sheltered workshops from disclosure and fingerprinting requirements for certain solid waste operations.

An Act concerning certain solid waste operations, and supplementing P.L.1983, c.392 (C.13:1E-126 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.   Notwithstanding any provision of P.L.1983, c.392 (C.13:1E-126 et seq.), or any rules or regulations adopted pursuant thereto, to the contrary, a sheltered workshop providing services to a county owned sanitary landfill facility shall be exempt from fingerprint and personal history disclosure requirements and shall not be required to file a disclosure statement required pursuant to P.L.1983, c.392.

     b.    As used in this section:

     "Sanitary landfill facility" shall have the same meaning as set forth in section 3 of P.L.1970, c.39 (C.13:1E-3).

     "Services" means services related to the county owned landfill operation, including collection, sorting, and baling activities, as well as beneficial reuse and sale of recyclables.

     "Sheltered workshop" means an organization that: (1) provides employment training or opportunities to people with disabilities; (2) is governed by a board of trustees or directors, whose voting members serve without compensation; (3) is certified by the New Jersey Department of Labor and Workforce Development; (4) is approved to vend services to the Department of Human Services; and (5) is qualified for exemption from federal taxation pursuant to section 501(c)(3) of the federal Internal Revenue Code, 26 U.S.C.s.501(c)(3).

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would exempt a sheltered workshop providing services to a county owned sanitary landfill facility from any requirement to file a disclosure statement pursuant to P.L.1983, c.392 (C.13:1E-126 et seq.), commonly referred to as "A901."

     The bill further provides that a sheltered workshop providing services to a county owned sanitary landfill facility would be exempt from fingerprint and personal history disclosure requirements pursuant to P.L.1983, c.392. 

     The bill defines a sheltered workshop as an organization that: (1) provides employment training or opportunities to people with disabilities; (2) is governed by a board of trustees or directors, whose voting members serve without compensation; (3) is certified by the New Jersey Department of Labor and Workforce Development; (4) is approved to vend services to the Department of Human Services; and (5) is qualified for exemption from federal taxation pursuant to section 501(c)(3) of the federal Internal Revenue Code, 26 U.S.C.s.501(c)(3).
