SYNOPSIS

     Authorizes municipalities that receive certification pursuant to the Fair Housing Act to make affordable housing units available on a preferential basis to persons of low and moderate income employed in a municipality's housing region.

An Act authorizing municipalities to make affordable housing units available on a preferential basis to persons of low and moderate income employed in a municipality's housing region and supplementing P.L.1985, c.222.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  a. The Legislature finds and declares that:

     (1)   An analysis of existing and future employment characteristics, as enunciated in section 10 of P.L.1985, c.222 (C.52:27D-310) is an important consideration in designing a municipality's housing element to achieve the goal of access to affordable housing to meet present and prospective housing needs.

     (2)  The availability of affordable housing to persons of low and moderate income in a municipality will lead to retention of jobs and employment growth in the municipality.

     (3)  That municipalities in the State can achieve their goals to ensure the availability of housing units that are affordable to persons of low and moderate income and simultaneously encourage retention of jobs and employment growth in the municipality.

     b.  Pursuant to rules promulgated by the council, a municipality which has received substantive certification from the council may make housing units available on a preferential basis to persons of low and moderate income who are employed in the municipality's housing region.

 

     2.  This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would allow municipalities that seek certification from the Council on Affordable Housing pursuant to the "Fair Housing Act," P.L.1985, c.222 (C.52:27D-301 et al.) to make housing available on a preferential basis to persons of low and moderate income employed in the municipality's housing region.
