SYNOPSIS

An Act concerning intermodal chassis and amending P.L.2005, c.234.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Section 13 of P.L.2005, c.234 is amended to read as follows:
13. This act shall take effect on the first day of the twelfth month following enactment. This act shall expire [upon:
a. the effective date of a federal statute to regulate the inspection and maintenance of intermodal chassis; or
b.] when final rules by the Federal Motor Carrier Safety Administration regulating the inspection and maintenance of intermodal chassis take effect.
2. This act shall take effect immediately.
STATEMENT
This bill amends the expiration date of P.L.2005, c.234 and provides that the act shall only expire once rules by the Federal Motor Carrier Safety Administration (FMCSA) regulating the inspection and maintenance of intermodal chassis take effect. P.L.2005, c.234 requires an intermodal equipment provider that tenders intermodal chassis for interchange in New Jersey to implement a systematic maintenance check program to inspect the chassis on a routine basis.
P.L.2005, c.234, signed into law on September 22, 2005, was to go into effect on September 1, 2006. The law was to expire upon either: 1) the effective date of a federal statute to regulate the inspection and maintenance of intermodal chassis, or 2) when final rules by the FMCSA regulating the inspection and maintenance of intermodal chassis took effect. Signed in August 2005, the federal Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users ("SAFETY-LU") directed the Secretary of the United States Department of Transportation to issue regulations establishing a program to ensure the safety and maintenance of intermodal equipment and SAFETY-LU provided minimal requirements for the contents of such regulations. To date, the FMCSA has proposed, but not yet finalized such regulations. This bill clarifies that the New Jersey law will remain effective until the FMSCA rules take effect.
