     Concerns use of digital parking meters to monitor parking compliance.

An Act concerning electronic parking compliance devices and supplementing Title 39 of the Revised Statutes. 

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  A State, county or municipal department, board, bureau, commission, agency, or parking authority may use a digital parking meter or other electronic parking compliance device in accordance with P.L.    , c.      (C.        )(pending before the Legislature as the bill) to monitor parking compliance within its jurisdiction.  As used in P.L.    , c.     (C.        )(pending before the Legislature as this bill), "digital parking meter or other electronic parking compliance device" means a parking meter or other electronic device that is installed in a fixed location to electronically monitor compliance with metered parking spaces using sensors, video or photo capture capabilities. The term does not include digital handheld parking citation writers used by law enforcement or parking code enforcement officers to facilitate the issuance of a complaint-summons after an officer personally observes a violation and the subsequent electronic processing of the complaint-summons through State or local court automatic systems.

     b.    A digital parking meter or other electronic parking compliance device may be used to alert a law enforcement or parking code compliance officer of a parking violation.  Any complaint-summons for a parking violation that may be issued by an officer receiving an alert from a digital parking meter or other electronic parking compliance device shall comply with the provisions of "The Parking Offenses Adjudication Act," P.L. 1985, c.14 (C.39:4-139.2 et seq). 

     c.     Unless specifically authorized by State law, a digital parking meter or other electronic parking compliance device shall not electronically process, issue, or serve upon an owner or operator of a motor vehicle a complaint-summons for a parking violation or interconnect with any State or local court automated system to process, issue, or serve a complaint-summons for a parking violation. 

     d.    A digital parking meter or other electronic parking compliance device capable of capturing a digital photograph or video shall not be installed or engineered for the sole purpose of taking a photograph or video of any occupant of a motor vehicle.

 

     2.    This act shall take effect immediately.

STATEMENT

 

This bill authorizes a State or local government entity or parking authority to use a digital parking meter or other electronic parking compliance device to monitor parking compliance within its jurisdiction.  The bill defines a "digital parking meter or other electronic parking compliance device" as a parking meter or other electronic device that is installed in a fixed location to electronically monitor compliance with metered parking spaces using sensors, video or photo capture capabilities. The term would not include digital handheld parking citation writers used by law enforcement or parking code enforcement officers to facilitate the issuance of a complaint-summons after an officer personally observes a violation and the subsequent electronic processing of the complaint-summons through State or local court automatic systems.            Under the bill, a digital parking meter or other electronic parking compliance device may be used to alert an officer of a parking violation.  The bill makes the issuance of a complaint-summons permissive once the officer receives an alert of a parking violation.  The complaint-summons, if issued, must be in compliance with the provisions of "The Parking Offenses Adjudication Act," P.L.1985, c.14 (C.39:4-139.2 et seq.). 

     The bill also provides that unless specifically authorized by State law, a digital parking meter or other electronic parking compliance device is not to be used to electronically process, issue, or serve upon an owner or operator of a motor vehicle a complaint-summons for a parking violation or interconnect with any State or local court automated system to process, issue, or serve a complaint-summons for a parking violation. 

     The bill prohibits a digital parking meter or other electronic parking compliance device from being installed or engineered for the sole purpose of taking a photograph or video of any occupant of a vehicle.
