STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eleven
AN ACT relative to the nursing assistant registry administered by the board of nursing.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Nurse Practice Act; Definitions. Amend RSA 326-B:2 by inserting after paragraph VII the following new paragraph:
VII-a. “Nurse” means a person authorized to practice nursing and who holds a current license to provide care as an APRN, RN, or LPN.
2 Collection of Funds; Reference Corrected. Amend RSA 326-B:6 to read as follows:
326-B:6 Collection and Expenditure of Funds. The board shall receive and expend funds provided such funds are received and expended for the pursuit of the objectives authorized by this chapter. Fees, fines, and administrative charges, [other than] including those [collected pursuant] related to RSA [326-B:8] 326-B:26, shall be deposited in the general fund.
3 Nursing Assistant Registry. Amend RSA 326-B:26 to read as follows:
326-B:26 [Licensed] Nursing Assistant Registry. The board shall maintain a registry of nursing assistants [licensed] who qualify pursuant to 42 C.F.R. section 483.156. Nursing assistants who are registered [or licensed] shall comply with all provisions of the Omnibus Budget Reconciliation Act (OBRA) of 1987, sections 1819 and 1919 of the Social Security Act, and all provisions of this chapter.
4 Repeal. The following are repealed:
I. RSA 326-B:7, relative to the nursing assistant fund.
II. RSA 6:12, I(b)(24), relative to moneys credited to the board of nursing’s nursing assistant fund.
5 Effective Date. This act shall take effect July 1, 2011.

SB 53 FISCAL NOTE
AN ACT relative to the nursing assistant registry administered by the board of nursing.
FISCAL IMPACT:
The New Hampshire Board of Nursing states this bill, as amended by the House (Amendment #2011-1582h), will have no fiscal impact on state, county or local expenditures and revenue.
METHODOLOGY:
The New Hampshire Board of Nursing states this bill makes changes to segregate the nursing assistant registry from the licensing and operating activities of the Board of Nursing. The Board indicates the changes are in response to Administrative Services Financial Audit recommendations in response to the LBA financial audit report for the six months ended December 31, 2008.
