AN ACT establishing a study commission to study automobile insurance for newly acquired vehicles.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Three

 

AN ACT establishing a study commission to study automobile insurance for newly acquired vehicles.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Commission Established; Automobile Insurance for Newly Acquired Vehicles.  Amend RSA 260 by inserting after section 78 the following new section:

260:79  Commission Established; Automobile Insurance for Newly Acquired Vehicles.

I.  There is established a commission to study requirements and coverages for private passenger vehicle insurance for newly acquired vehicles.

II.  The commission shall consist of the following members:

(a)  Six members of the house of representatives, one of whom shall be a member of the house commerce committee, and appointed by the speaker of the house;

(b)  One senate members, one of whom shall be a member of the senate commerce committee, and appointed by the senate president;

(c)  The commissioner of the department of insurance or their designee;

(d)  One member of the Professional Insurance Agents of New Hampshire, who shall be designated by that organization;

(e)  One member of the New Hampshire Association of Insurance Agents, who shall be designated by that organization;

(f)  One member of the New Hampshire Automobile Dealers Association, who shall be designated by that organization;

(g)  Two member of the public, who shall be appointed by the governor.

III.  Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.  The comission's study shall include current coverages, prospective coverages, and their impacts and timing when private passenger vehicles are purchased.

IV.  The commission may solicit input from any person or entity the commission deems relevant to its study.

V.  The members of the commission shall elect a chairperson from among the members.  The first meeting of the commission shall be held within 45 days of the effective date of this section and be called by the first-named house member.  Six members of the commission shall constitute a quorum.

VI.  The commission shall submit a report including its findings and any recommendations for proposed legislation on or before November 1, 2023 to the speaker of the house of representatives; the president of the senate, the house clerk, the senate clerk, the governor, and the state library.

2  Prospective  Repeal.  RSA 260:79, relative to a commission to study automobile insurance for newly acquired vehicles., is repealed.

3  Effective Date.  

I.  Section 2 of this act shall take effect November 1, 2023.

II.  The remainder of this act shall take effect upon its passage.
