STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Nineteen

 

AN ACT establishing a stormwater management and flood resilience fund within the department of environmental services and making an appropriation to the fund.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Subdivision; Stormwater Management and Flood Resilience Fund.  Amend RSA 483-B by inserting after section 22 the following new subdivision:

Stormwater Management and Flood Resilience Fund

483-B:23  Stormwater Management and Flood Resilience Fund.

I.  There is hereby established in the office of the state treasurer a fund to be known as the stormwater management and flood resilience fund, which shall be kept distinct and separate from all other funds.  All moneys in the fund shall be nonlapsing and continually appropriated to the department of environmental services for the purposes of this section.

II.  The department of environmental services shall use the money from the stormwater management and flood resilience fund to give grants to public and non-profit organizations, such as municipalities, regional planning commissions, and other regional organizations for the monitoring, treatment of, and outreach regarding stormwater pollution and flood resilience.

(a)  Of those grants, $100,000 shall be dedicated to address high-priority monitoring needs to ensure stormwater management and resilience objectives set by the final report of the coastal risk and hazards commission, established in RSA 483-E:1, are being met.

(b)  The remaining money shall be allocated to municipalities and eligible non-profit organizations to complement stormwater practices with priority given to:

(1)  Improvement and protection of water quality;

(2)  Building resilience to the risks of storm surge, projected sea level rise, increased impact from major storm events to human infrastructure and tidal and freshwater ecosystems, and extreme precipitation events;

(3)  Regional coordination; and

(4)  Transference of lessons learned to other municipalities and peer to peer interaction.

2  Department of Environmental Services; Appropriation; Stormwater Management and Flood Resilience Fund.  The sum of $400,000 for the fiscal year ending June 30, 2020, is hereby appropriated to the department of environmental services for the stormwater management and flood resilience fund established in RSA 483-B:23.  The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.

3  New Paragraph; Duties of the Commissioner.  Amend RSA 483-B:5 by inserting after paragraph V the following new paragraph:

VI.  The commissioner shall establish and publish criteria, forms, deadlines, and a distribution schedule for the stormwater management and flood resilience program under RSA 483-B:23.

4  New Subparagraph; Stormwater Management and Flood Resilience Fund.  Amend RSA 6:12, I(b) by inserting after subparagraph (343) the following new subparagraph:

(344)  The stormwater management flood and resilience fund established in RSA 483-B:23.

5  Effective Date.  This act shall take effect July 1, 2019.

METHODOLOGY:

This bill establishes a stormwater management and flood resilience fund within the Department of Environmental Services.  Based on the appropriation language in the bill, the Department of Environmental Services assumes this is an annual appropriation to the fund expenditures that will continue at the same level as in the first year.  The Department indicates municipalities are likely to be one class of grant recipients, but cannot determine how much the municipalities would receive.  The Department does not expect the counties will be impacted by this bill.
