AN ACT relative to the age at which a minor may receive mental health treatment without parental consent.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Three

 

AN ACT relative to the age at which a minor may receive mental health treatment without parental consent.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Subdivision; Mental Health Practice; Services Provided to Minors.  Amend RSA 135-C by inserting after section 67 the following new subdivision:

Mental Health Services for Minors

135-C:68  Mental Health Services for Minors.  Any minor 16 years of age or older may voluntarily consent to mental health services, and a licensed mental health care provider may provide such services without the consent of the minor’s parent or legal guardian, provided, however, that the provider shall not prescribe medication without the consent of a parent or guardian.

2  Effective Date.  This act shall take effect 60 days after its passage.
