STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT requiring inclusion of home educated pupils in the definition of average daily membership in attendance.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 School Money; Definitions. Amend RSA 198:38, I to read as follows:

I.(a) “Average daily membership in attendance” or “ADMA” means the average daily membership in attendance of pupils in kindergarten through grade 12, as defined in RSA 189:1-d, III of the school year in which the calculation is made, provided that no kindergarten pupil shall count as more than 1/2 day attendance per calendar year.

(b) For the purpose of calculating ADMA, each pupil who is home educated in compliance with RSA 193-A and who participates in a public school activity shall count as 0.1 pupil, and each such home educated pupil shall count as an additional 0.15 pupil for each academic course taken in a public school. No co-curricular activity, as defined by the department of education, shall count as an academic course for the purpose of calculating ADMA.

2 Effective Date. This act shall take effect 60 days after its passage.

SB 151-FN - FISCAL NOTE

AN ACT requiring inclusion of home educated pupils in the definition of average daily membership in attendance.

FISCAL IMPACT:

The Department of Education states this bill, as introduced, will increase state education trust fund expenditures and local revenue by an indeterminable amount in FY 2016 and each year thereafter. There will be no impact on county and local expenditures, or state and county revenue.

METHODOLOGY:

The Department of Education states this bill would allow for the inclusion of home schooled students in a school district’s calculation of “average daily membership in attendance” (ADMA) to the extent they participate in public school activities and academic courses. The Department notes the proposed legislation allows for each home schooled student to be counted as 0.1 pupils for participation in public school activities, and 0.15 pupils for each academic course taken.

The Department states any increase in a school district’s ADMA could potentially result in an increase in the district’s adequate education grant thereby increasing state education trust fund expenditures and local revenues. The Department notes current ADMA data collections do not require school districts to submit attendance records for home schooled students participating in public school activities or academic courses. The absence of this data precludes the Department’s ability to determine the exact fiscal impact at this time.
