In the Year of Our Lord Two Thousand Twenty Three
AN ACT relative to criminal background checks for charitable games of chance license applicants.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Games of Chance; Background and Criminal Records Check. Amend RSA 287-D:12 by inserting after paragraph VI the following new paragraph:
VII. Members of a charitable organization that do not participate directly in the operation of games of chance shall be exempt from the requirements of this section.
2 Effective Date. This act shall take effect January 1, 2024.

METHODOLOGY:
This bill eliminates the criminal record requirement for members of a charitable organization who are not actively participating in the operation of a games of chance event. In 2022, approximately 590 members of charitable organizations submitted a release of their criminal records. It is unknown if these members would otherwise be requesting criminal records checks not related to the Lottery requirement, therefore this bill’s impact on revenue and expenditures of the criminal records fund (administered by the Department of Safety) is unknown. However, if the 590 members of charitable organizations do not have a criminal record check at a cost of $48.25 per request, total potential loss of revenue would be less than $30,000 per year (or $15,000 in FY 2024 since this bill is effective January 1, 2024).
This bill will have no impact on Lottery revenue or expenditures.
