STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT relative to the determination of underemployment in child support cases.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Subparagraph; Child Support Guidelines; Definition of Gross Income; Underemployment. Amend RSA 458-C:2, IV by inserting after subparagraph (c) the following new subparagraph:

(d) In determining whether a parent is voluntarily underemployed under subparagraph (a) or (b), the court shall consider the nature of the parent’s current and previous employment, the reason for the change in employment, and any additional factors the court deems relevant.

2 Effective Date. This act shall take effect January 1, 2016.
