STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Nineteen
AN ACT establishing a commission to study occupational licensing reforms.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Occupations and Professions; Commission Established. Amend RSA 332-G by inserting after section 4 the following new section:
332-G:4-a Commission Established. There is established a commission to study possibilities for reforming New Hampshire's occupational licensing requirements and procedures to reduce barriers to licensure and to increase New Hampshire's economic competitiveness.
I. The members of the commission shall be as follows:
(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.
(b) Two members of the senate, appointed by the president of the senate.
(c) The executive director of the office of professional licensure and certification, or designee.
(d) The commissioner of the department of business and economic affairs, or designee.
(e) Two members of technical division boards under the office of professional licensure and certification, appointed by the governor.
(f) Two members of health division boards under the office of professional licensure and certification, appointed, by the governor.
(g) The executive director of the American Civil Liberties Union of New Hampshire, or designee.
II. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.
III. The commission shall study:
(a) Reforms for reducing the barriers to occupational licenses for impacted communities, including veterans and military spouses, and individuals with criminal records.
(b) Reforms for increasing the portability of occupational licenses issued by New Hampshire across state lines.
(c) Reforms for increasing New Hampshire's reciprocity of occupational licenses obtained from out of state.
(d) Improvements to the standardization of vocabulary and standards across New Hampshire occupational licenses.
(e) Possible occupations that should be newly licensed or de-licensed.
(f) Methods of data collection on the demographics of licensure applicants, including those who receive and are denied licensure.
IV. The commission may solicit advice and testimony from any interested party, including but not limited to:
(a) The state office of veterans affairs.
(b) The department of corrections.
(c) The department of employment security.
(d) Members of occupational licensing boards.
V. The members of the study commission shall elect a chairperson from among the legislative members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Seven members of the commission shall constitute a quorum.
VI. The commission shall meet at least 4 times prior to submission of its report.
VII. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2019.
2 Repeal. RSA 332-G:4-a, relative to the commission to study occupational licensing reforms, is repealed.
I. Section 2 of this act shall take effect November 1, 2019.
II. The remainder of this act shall take effect upon its passage.
