HOUSE BILL 397

AN ACT relative to state aid for wastewater and public water supply projects.

ANALYSIS

This bill requires the commissioner of the department of environmental services to give priority for state aid to communities with wastewater and public water supply projects that were eligible for such aid, but unfunded in fiscal years 2012 and 2013 and to those projects listed on the draft project lists for fiscal years 2013 and 2014 and the extended portion of the draft project list beyond 2014, on a first-in, first-out basis as such funds become available.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to state aid for wastewater and public water supply projects.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Wastewater and Public Water Supply Projects; Priority Given. Amend 2010, 63:1 to read as follows:

63:1 Wastewater and Public Water Supply Projects; Priority Given. As new revenue or appropriations become available to fund state aid under RSA 486 or RSA 486-A, the department of environmental services shall give priority on a first-in, first-out basis to communities that had wastewater projects eligible under RSA 486 or public water supply projects eligible under RSA 486-A that were not funded in fiscal year 2009, fiscal year 2010, [or] fiscal year 2011, fiscal year 2012, or fiscal year 2013, and to those projects that were approved by warrant article passed before the end of calendar year 2008 that are listed on the fiscal year 2013 draft project list dated August 31, 2012, the fiscal year 2014 draft project list dated August 31, 2112 and the extended portion of the draft project list beyond fiscal year 2014 dated August 31, 2012.

2 Effective Date. This act shall take effect upon its passage.
