STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT establishing a commission to develop an energy policy for the state.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Commission to Create an Energy Policy for the State. Amend RSA 162-H by inserting after section 20 the following new section:

162-H:21 Commission Established.

I. There is hereby established a commission to develop an energy policy for the state. The commission shall consist of the following members:

(a) Two members of the house of representatives, one from the republican party and one from the democratic party, neither of whom shall be employed by or have any affiliation with a company in the business of transmission, appointed by the speaker of the house of representatives.

(b) One member of the senate, appointed by the president of the senate.

(c) Two representatives of public utilities, appointed by the governor.

(d) Three ratepayers, appointed by the governor.

II. The commission shall:

(a) Investigate the feasibility of using state transportation rights of way for electric transmission lines and the feasibility of placing electric transmission lines underground.

(b) Develop a state policy for energy transmission.

III. Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

IV. Chairperson; Quorum. The members of commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named house member. The first meeting of the commission shall be held within 45 days of the effective date of this section and at least monthly thereafter. Five members of the commission shall constitute a quorum.

2 Report. The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, the commissioners of the public utilities commission and the state library in the form of an interim report on or before December 1, 2013 and a final report on or before December 1, 2014.

3 Repeal. RSA 162-H:21, relative to a commission to develop an energy policy for the state, is repealed.

4 Effective Date.

I. Section 3 of this act shall take effect December 1, 2014.

II. The remainder of this act shall take effect upon its passage.
