STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to registration fees for commercial, private, and pleasure vessels.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Vessel Registration; Registration Fees. Amend RSA 270-E:5, II(a) to read as follows:

(a) [$7.50] $9.50 for each registration specified in paragraph I. The fees collected under this subparagraph shall be paid into the lake restoration and preservation fund established under RSA 487:25.

2 Lake Restoration and Preservation Fund; Addition to Boat Registration. Amend RSA 487:25, I to read as follows:

I. The fee of [$7.50] $9.50 collected under the provisions of RSA 270-E:5, II(a) shall be paid to the director of the division of motor vehicles. The director of the division of motor vehicles shall pay over said fee to the state treasurer who shall keep the fee in a special fund to be expended by the department of environmental services. The department shall use $.50 of the fee for lake restoration and preservation measures, exclusive of exotic aquatic weed control, [$3] $5 of the fee for the control of exotic aquatic weeds, and $4 of the fee for the milfoil and other exotic aquatic plants prevention program. The department shall deposit the $4 into a special account within the lake restoration and preservation fund which shall be used to administer the milfoil and other exotic aquatic plants prevention program. The special fund shall be nonlapsing. All funds received under this section are continually appropriated to the department for the purposes of this subdivision.

3 Effective Date. This act shall take effect January 1, 2015.

HB 292-FN-A FISCAL NOTE

AN ACT relative to registration fees for commercial, private, and pleasure vessels.

FISCAL IMPACT:

The Department of Environmental Services and Department of Safety state this bill, as amended by the House (Amendment #2013-2269h), will increase state restricted revenue by $156,040 in FY 2015, and by $188,000 in FY 2016 and each year thereafter, increase state restricted expenditures by $4,200 in FY 2015, increase local revenue by $75,920 in FY 2015, and by $94,000 in FY 2016 and each year thereafter, and increase local expenditures by an indeterminable amount in FY 2015 and each year thereafter. There will be no impact on county revenue and expenditures.

METHODOLOGY:

The Departments of Environmental Services and Safety state this bill increases the vessel registration fee by $2.00 per vessel and directs the increased revenue to the lake restoration and preservation fund established by RSA 487:25. The Departments estimates approximately 94,000 vessels are registered in NH each year, with 83 percent registered between January 1 and June 30 of a given year. Revenue to the lake restoration and preservation fund will increase by $156,040 (94,000 vessel registrations * $2.00 * 83%) in FY 2015 and $188,000 (94,000 vessel registrations * $2.00) each year thereafter. The Department of Environmental Services states based on existing practices, about half of the increased revenue is distributed to lake associations and the other half is distributed as grants to municipalities. The Department assumes municipal expenditures will increase by the same amount as any increase in revenue. It is assumed municipal revenue will increase by $75,920 in FY 2015 (($156,040 revenue - $4,200 Department of Safety expenses)/2) and by $94,000 in FY 2016 and each year thereafter.

The Department of Safety states it will have increased expenditures associated with programming updates to databases used in conjunction with the vessel registrations and assumes these expenditures will be paid for by the increased revenue to the fund. The Department estimates it will require 24 hours of programming time at $175 hour or $4,200 in FY 2015. The Department states local expenditures will increase due to vendor software changes needed as a result of this bill. The Department has no information to determine the increased local expenditures.
