This bill requires manufacturers to pre-package class II controlled drugs which are going to be dispensed in New Hampshire in blister packs with serial numbers on each pill.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to packaging of certain controlled drugs.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Packaging of Class II Controlled Drugs.  Amend RSA 318-B by inserting after section 9 the following new section:

318-B:9-a  Packaging of Class II Controlled Drugs.  Manufacturers packaging class II controlled drugs to be dispensed in New Hampshire shall pre-package such drugs in individual dose blister packs with traceable inventory serial numbers on each pill.  

2  Effective Date.  This act shall take effect January 1, 2019.

METHODOLOGY:

The Department of Health and Human Services assumes implementation of the packaging and tracking requirements in New Hampshire could cause some manufacturers to cease distributing class II drugs in New Hampshire or increase their prices to cover the additional packaging, tracking and distribution costs.  The increase in costs to the Medicaid program for class II controlled drugs cannot be determined.  Medicaid expenditures are paid with a combination of state and federal funds, therefore any increase in Medicaid expenditures will also increase federal restricted revenue by 50% of the expenditure increase.   

 

The Office of Professional Licensure and Certification states this bill would have no fiscal impact on the Office or on the Board of Pharmacy.
