STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT repealing the repeal of the pollution prevention program of the department of environmental services.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Purpose.  The general court finds that the pollution prevention program established in RSA 21-O:15 through RSA 21-O:21 has consistently demonstrated its value to the businesses and citizens of New Hampshire by encouraging enhanced voluntary compliance with environmental laws.  The general court further finds that the pollution prevention program has not provided opportunities for avoiding such compliance.  It thus is the intent of the general court that RSA 21-O:15 through RSA 21-O:21 no longer be subject to a prospective repeal.

2  Repeal.  1996, 8:9, I, relative to the repeal of the pollution prevention program, is repealed.

3  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill repeals the 1996 repeal of the Pollution Prevention program of the Department of Environmental Services. Chapter 8:9, I, Laws of 1996 repealed this program prospectively as of July 1, 2002.  Chapter 74:3, Laws of 2002 extended the repeal date prospectively as of July 1, 2010.  Chapter 167:4, Laws of 2009 extended the repeal date prospectively as of July 1, 2020.  

 

The Department of Environmental Services states the costs of periodically seeking legislation to extend the Pollution Prevention Program can't be quantified, but have been absorbed in existing budgets.  If current law remains unchanged and the program ends on July 1, 2020, there would be a reduction in program expenses.  The FY 2019 cost of the program is currently $221,113 which includes $180,946 for salaries and benefits and $40,167 for other costs, including current expenses, phone, rent, travel, indirect and additional fringe charges.  Based on the FY 2019 budget for the program, and assuming a 2 percent increase in salaries and benefits only,  the Department estimates the following costs for FY 2020 - FY 2022:
