AN ACT relative to exclusion of incarceration as voluntary unemployment for purposes of calculating child support.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to exclusion of incarceration as voluntary unemployment for purposes of calculating child support.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Child Support Guidelines; Definition of Gross Income; Incarceration Not Considered Voluntary Unemployment.  Amend RSA 458-C:2, IV(a) to read as follows:

(a)  The court, in its discretion, may consider as gross income the difference between the amount a parent is earning and the amount a parent has earned in cases where the parent voluntarily becomes unemployed or underemployed, unless the parent is physically or mentally incapacitated; provided that in no case shall incarceration be considered voluntary unemployment.

2  Effective Date.  This act shall take effect January 1, 2025.
