AN ACT relative to part-time employment of a retirement system retiree.

This bill increases the number of hours a retiree may work for a retirement system employer and eliminates the initial 28-day  restriction on such part-time employment after retiring.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Two

 

AN ACT relative to part-time employment of a retirement system retiree.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Retirement System; Part-time Employment.  Amend RSA 100-A:1, XXXIV to read as follows:

XXXIV. "Part-time" for purposes of employment of a retired member of the New Hampshire retirement system but excepting per diem court security officers and court bailiffs, means employment by one or more participating employers of the retired member which shall not exceed [1,352] 1,664 hours in a calendar year, except as provided in RSA 100-A:7-b. [Notwithstanding the foregoing, no retired member shall be employed on a part-time basis by any participating employer for a period of 28 days from the member's effective date of retirement.]

2  Effective Date.  This act shall take effect 60 days after its passage.

*The New Hampshire Retirement System states it is not able to separate the fiscal impact of this legislation between county and local government, therfore the fiscal impact is shown together as political subdivision.

 

METHODOLOGY:

This bill increases the number of hours a New Hampshire Retirement System (NHRS) retiree may work in a calendar year, for a NHRS participating employer, from 1,352 to 1,664 and eliminates the initial 28-day restriction on such part-time employment after retiring.  The NHRS states there is no fiscal impact to the increase in limit on the number of hours nor the elimination of the 28-day prohibition on part-time work for new retirees.  However, to the extent the need for full-time positions are reduced there would be an indeterminable impact on state, county and local expenditures.

 

It is assumed any fiscal impact would not occur until FY 2023.
