SENATE BILL 159
AN ACT to transfer the blue ridge correctional facility to mayland community college for the expansion of existing community college programs and the development of new programs.
The General Assembly of North Carolina enacts:
Whereas, the BRIDGE program (Building, Rehabilitating, Instructing, Developing, Growing, and Employing) was operated at the Blue Ridge Correctional Facility located on Prison Camp Road in Avery County from 1990 until 2002; and
Whereas, since 2002, the Blue Ridge Correctional Facility has been closed and sitting idle at cost to the Department of Corrections and the State; and
Whereas, Mayland Community College serves the citizens of Mitchell, Avery, and Yancey Counties; and
Whereas, the Mayland Community College campus is located in Spruce Pine, five miles from the Blue Ridge Youth Prison Facility; and
Whereas, based on the Mayland Community College Long‑Range Plan, the college is lacking 100,000 square feet of classroom, shop, and laboratory space as determined by the Student/Faculty Ratio utilized by the North Carolina Community College System; and
Whereas, the current economic downturn has impacted Mitchell, Avery, and Yancey Counties such that the counties do not have the industrial or retail activity to produce a tax base sufficient to support the construction of needed facilities; and
Whereas, the Blue Ridge Correctional Facility would provide valuable instructional space and property for existing programs as well as future growth; and
Whereas, Mayland Community College will seek additional sources of external funding to cover the costs of renovation, maintenance, and insurance of the Blue Ridge Correctional Facility; Now, therefore,
The General Assembly of North Carolina enacts:
SECTION 1. The State of North Carolina shall convey to the Board of Trustees of Mayland Community College, for consideration of one dollar ($1.00), all right, title, and interest in the Blue Ridge Correctional Facility, being a portion of the tract identified in Deed Book 32, page 290 of the Avery County Register of Deeds and as Tax Parcel No. 182200083490, as further described below:
Blue Ridge Correctional Facility Site:
Blue Ridge Youth Prison Facility/3950 is part of Complex Number 1‑6‑6 entitled Avery Correctional Center/Blue Ridge Youth Center/4614/3950. The Facility is located on that portion of Complex Number 1‑6‑6 lying south of Prison Camp Road and consists of the following buildings, accompanied by 13.21 deeded acres. The buildings and assets include:
1. Dormitory Asset #33.
2. Kitchen/Administration Asset #34.
3. Visitors Check‑In Building Asset #35.
4. Transformer Building Asset #36.
5. Well House Asset #37.
6. B Dormitory Asset #43.
The property does not include the Forest Service building and land, comprising approximately 10 acres, located on that portion of Complex Number 1‑6‑6 lying south of Prison Camp Road.
SECTION 2. The State of North Carolina shall convey the real property described in Section 1 "as is" "where is" without warranty. The State makes no representations or warranties concerning the title to the property, the boundaries of the property, the uses to which the property may be put, zoning, local ordinances, or any physical, environmental, health, and safety conditions relating to the property. All costs associated with the conveyance of the property shall be borne by Mayland Community College.
SECTION 3. The conveyance of the State's right, title, and interest in the Blue Ridge Correctional Facility shall be exempt from the provisions of Article 7 of Chapter 146 of the General Statutes. The conveyance shall comply with the provisions of Article 16 of Chapter 146 of the General Statutes; provided that the provisions of G.S. 146‑74 shall not apply.
SECTION 4. This act is effective when it becomes law.

This bill having been presented to the Governor for signature on the 16th day of June, 2011 and the Governor having failed to approve it within the time prescribed by law, the same is hereby declared to have become a law. This 27th day of June, 2011.
