A BILL TO BE ENTITLED

AN ACT to repeal the continuing education requirement for used motor vehicle dealers, to require the division of motor vehicles to provide notice or rule or regulation changes to licensed motor vehicle dealers, and to require the license and theft bureau of the division of motor vehicles to study how to improve enforcement of the laws governing the transfer of title or interest in a motor vehicle.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 20‑288(a1)(2) is repealed.

SECTION 2.  G.S. 20‑288 is amended by adding a new subsection to read:

"(b2)    Within 30 calendar days of adopting or amending a rule or regulation affecting a person licensed under this section, the Division shall provide notice of the adopted or amended rule or regulation to the license holder in accordance with G.S. 20‑48."

SECTION 3.  The License and Theft Bureau of the Division of Motor Vehicles shall study how to improve enforcement of the laws set forth in Part 4 of Article 3 of Chapter 20 of the General Statutes, specifically enforcement against auctioneers and licensed motor vehicle dealers transferring title or interest in a motor vehicle. The License and Theft Bureau shall submit its findings, including any legislative recommendations, to the Joint Legislative Transportation Oversight Committee by December 15, 2017.

SECTION 4.  Section 2 of this act becomes effective July 1, 2017. The remainder of this act is effective when it becomes law.
