AN ACT TO DIRECT THE STATE FISCAL OFFICER TO MAKE TRANSFERS OF CERTAIN FUNDS; TO PROVIDE THAT THE DEPARTMENT OF FINANCE AND ADMINISTRATION SHALL NOT BE AUTHORIZED TO ESCALATE CERTAIN FUNDS DURING FISCAL YEAR 2021; TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION TO ESCALATE CERTAIN FUNDS DURING FISCAL YEAR 2020; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  Upon the effective date of this act, the State Fiscal Officer shall transfer to the Capital Expense Fund out of the Budget Contingency Fund (Fund Number

6117700000).................................. $    7,599,822.00.

     (2)  Upon the effective date of this act, the State Fiscal Officer shall transfer to the Budget Contingency Fund out of the DFA CARES ACT COVID-19 Fund (Fund Number

6820113000).................................. $1,150,000,000.00.

     SECTION 2.  The Department of Finance and Administration shall not escalate the budget of any agency, department or institution of the state for fiscal year 2021 for the expenditure of any funds received by the state under the federal Coronavirus Aid, Relief, and Economic Security Act (P.L. 116-136), unless the escalation is specifically authorized in an appropriation bill for the agency, department or institution.

     SECTION 3.  During fiscal year 2020, the Department of Finance and Administration shall have the authority to receive, budget and escalate federal funds in the DFA CARES ACT COVID-19 Fund (Fund Number 6820113000) in an amount not to exceed One Hundred Million Dollars ($100,000,000.00) for defraying expenses incurred by any state agency, department or institution for the purposes provided under the federal Coronavirus Aid, Relief, and Economic Security Act (P.L. 116-136).

     SECTION 4.  This act shall take effect and be in force from and after its passage.
