AN ACT TO AMEND SECTION 73-7-12, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT THE STATE BOARD OF COSMETOLOGY SHALL CONDUCT STUDENT EXAMINATIONS INSTEAD OF CONTRACTING WITH A TESTING SERVICE; TO PROHIBIT THE MEMBERS OF THE BOARD FROM PERSONALLY ADMINISTERING OR MONITORING THE EXAMINATIONS, AND DIRECT THE  BOARD TO CONTRACT FOR ADMINISTRATORS OF THE EXAMINATIONS; TO PROVIDE THAT A MEMBER OF THE BOARD SHALL NOT RECEIVE ANY PER DIEM COMPENSATION FOR ANY DAY THAT THE MEMBER IS PRESENT AT THE SITE WHERE THE EXAMINATIONS ARE BEING ADMINISTERED; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 73-7-12, Mississippi Code of 1972, is amended as follows:

     73-7-12.  (1)  Effective January 1, 2020, the State Board of Cosmetology shall * * * contract with a recognized testing service to terminate its student testing contract with proper notice and shall conduct examinations for cosmetologists, estheticians, manicurists and instructors at such times and locations as determined by the * * * contracted testing service board. * * *  No  The members of the board shall * * * be authorized to not personally administer or monitor the examinations, but the board shall contract for administrators of the examinationsA member of the board shall not receive any per diem compensation for any day that the member is present at the site where the examinations are being administered.

     (2)  This section shall stand repealed on July 1, 2021.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2019.
