AN ACT TO AUTHORIZE GOVERNING AUTHORITIES TO CHARGE A FEE, OR REQUIRE A FEE TO BE PAID TO A THIRD-PARTY SERVICE PROVIDER, FOR AN ELECTRONIC BID SUBMISSION OR PARTICIPATION IN A REVERSE AUCTION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  Any governing authority accepting electronic bid submissions for procurements may charge the bidder a fee, or may require a fee to be paid to a third-party service provider, for an electronic bid submission.  The amount of the fee shall not exceed Fifty Dollars ($50.00) per bid.

     (2)  Any governing authority using the reverse auction method of procurement may charge the winning bidder a fee, or require the winning bidder to pay a fee to a third-party service provider, for participation in a reverse auction.  The amount of the fee shall not exceed four percent (4%) of the winning bid amount.

     SECTION 2.  Section 1 of this act shall be codified as a separate section within Chapter 7, Title 31, Mississippi Code of 1972.

     SECTION 3.  This act shall take effect and be in force from and after its passage.
