MISSISSIPPI LEGISLATURE

AN ACT TO REQUIRE RETAIL DEALERS AND DISTRIBUTORS OF GASOLINE TO OFFER FOR SALE OR USE NONETHANOL-BLENDED UNLEADED REGULAR GRADE GASOLINE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  For the purposes of this section, the following terms shall have the meanings ascribed below, unless the context clearly indicates otherwise:

          (a)  "Antiknock index number" means the number assigned to a spark ignition engine fuel that designates the fuel's ability to resist engine knock.

          (b)  "Distributor" means any person engaged in the sale, consignment or distribution of petroleum products to wholesale or retail outlets, whether or not such person owns, leases or in any way controls such outlets.

          (c)  "Retail dealer" means any person who operates a service station, filling station, store, garage or other place of business for the sale of motor fuel for delivery into the service tank or tanks of any vehicle propelled by an internal combustion engine.

          (d)  "Retail fuel outlet" means a place at which gasoline and oil are stored and supplied to the public, which is operated directly by a refiner or distributor.

     (2)  Any retail dealer and any distributor, doing business in the State of Mississippi, shall hold, store, import, transfer and offer for sale or use nonethanol-blended unleaded regular grade gasoline with an antiknock index of at least eighty-seven (87) or greater.

     (3)  The Commissioner of Agriculture and Commerce is authorized to promulgate any rules and regulations necessary to carry out the provisions of this section.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2015.
