AN ACT TO AUTHORIZE THE DIVISION OF MEDICAID TO REIMBURSE FOR SERVICES PROVIDED TO ELIGIBLE MEDICAID BENEFICIARIES BY A LICENSED FREESTANDING PSYCHIATRIC HOSPITAL; TO AUTHORIZE THE DIVISION TO SEEK ANY NECESSARY WAIVERS, MAKE ANY REQUIRED AMENDMENTS TO ITS STATE PLAN, OR REVISE ANY MANAGED CARE CONTRACTS AS NECESSARY TO PROVIDE THE SERVICES AUTHORIZED UNDER THIS SECTION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The Division of Medicaid is authorized to reimburse for services provided to eligible Medicaid beneficiaries by a licensed freestanding psychiatric hospital in a method and manner to be determined by the division in accordance with federal law and federal regulations.  The division may seek any necessary waivers, make any required amendments to its State Plan, or revise any contracts authorized under Section 43-13-117(H) as necessary to provide the services authorized under this section.  As used in this section, the term "psychiatric hospital" shall have the meaning as defined in  Section 41-7-173(h)(ii), which is an institution that is primarily engaged in providing to inpatients, by or under the supervision of a physician, psychiatric services for the diagnosis and treatment of persons with mental illness.  It is the intent of the Legislature that the cost of providing services to individuals in a psychiatric hospital shall not exceed the cost of providing the same services to individuals in a hospital as defined by Section 41-7-173(h)(i).

     SECTION 2.  This act shall take effect and be in force from and after its passage.
