MISSISSIPPI LEGISLATURE

House Bill 891

AN ACT TO PROHIBIT ANY ENTITY THAT IS FUNDED, DIRECTLY OR INDIRECTLY, WITH STATE OR FEDERAL MONIES FROM DISTINGUISHING BETWEEN STUDENTS IN THE PROGRAMS AND ACTIVITIES UNDER THE PURVIEW OF THAT ENTITY BASED UPON THE SCHOOL IN WHICH A STUDENT IS ENROLLED; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  Any organization, association or other entity, whether public or private, which directly or indirectly is funded, in whole or in part, with state or federal monies may not distinguish between students based upon the school in which a student is being educated.  All students who meet the general eligibility criteria for participation in a program or activity affiliated with or administered or governed by any such organization, association or other entity must be allowed to participate in those programs or activities, regardless of the school in which a student is being educated, on the same basis and subject to the same rules and regulations that are applicable to all students.  

     (2)  Any organization, association or other entity that is funded, in whole or in part, by the receipt of payments from an entity or entities that receive state or federal funding is considered to be funded by state or federal monies for purposes of this section.

     (3)  The term "school," as used in this section, has the definition given to that term under the Mississippi Compulsory School Attendance Law (Section 37-13-91).

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2022.
