House Bill 813

     AN ACT TO CREATE A FELONY OFFENSE REGARDING THROWING OBJECTS FROM AN OVERPASS AND STRIKING A MOTOR VEHICLE; TO PROVIDE PENALTIES FOR VIOLATIONS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Any person who shall throw, hurl or otherwise project any object from an overpass or other structure over a public highway, road or street and strike a motor vehicle shall be guilty of a felony and, upon conviction, shall be punished by imprisonment for not more than five (5) years or by a fine of not more than Five Thousand Dollars ($5,000.00), or both.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2010.
