House Bill 603

AN ACT TO PROVIDE THAT A CLAUSE IN A CONTRACT FOR THE SALE OF A MOTOR VEHICLE WHICH ALLOWS THE USE OF A GLOBAL POSITIONING SYSTEM TO DISCONNECT THE IGNITION OF THE MOTOR VEHICLE SHALL BE IN BOLD PRINT IN A SEPARATE CLAUSE WHICH REQUIRES A SEPARATE SIGNATURE; TO REQUIRE NOTICE BEFORE ENFORCING THE CLAUSE; TO PROVIDE A PENALTY FOR VIOLATIONS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  It shall be unlawful for any contract for the sale of a motor vehicle to have a clause in the contract which allows the use of a Global Positioning System (GPS) to disconnect or disengage the ignition system of the motor vehicle if a payment on the motor vehicle is not made or insurance is not in force unless the clause is in a separate clause which is in bold print and which requires a separate signature for the clause.  If any condition exists which would allow the use of a GPS to disconnect or disengage the ignition system, then a ten-day notice by first class mail shall be sent to the party subject to such action informing the party that the ignition will be disconnected or disengaged in ten (10) days if payment is not made on the account to make it current or insurance is not acquired.  The ten-day notice time period shall commence on the day the notice is post marked.

     (2)  A violation of this section shall be a misdemeanor punishable by a fine of One Hundred Dollars ($100.00).

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2010.
