MISSISSIPPI LEGISLATURE

House Bill 1204

AN ACT TO CREATE THE OFFENSE OF CHILD ENDANGERMENT REGARDING THE USE OF ALL-TERRAIN VEHICLES BY MINORS; TO PROVIDE PENALTIES FOR VIOLATIONS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  Any parent, guardian or other person who allows a child under the age of eighteen (18) years to operate an all-terrain vehicle under the following conditions:

          (a)  Without a crash helmet that complies with minimum guidelines established by the National Highway Traffic Safety Administration pursuant to the National Traffic and Motor Vehicle Safety Act of 1966 for helmets designed for use by motorcyclists; and

          (b)  Not meeting the all-terrain manufacturer's recommendations as to the minimum age and maximum number of riders applicable to the type and model of vehicle being operated; shall be guilty of child endangerment, a misdemeanor, and, upon conviction, shall be punished by a fine of not more than One Thousand Dollars ($1,000.00) or imprisonment in the county jail for not more than six (6) months, or both.

     (2)  For the purposes of this section "all-terrain vehicle" means any motorized vehicle manufactured and designed exclusively for off-road use that is sixty (60) inches or less in width, has an unladen dry weight of seven hundred fifty (750) pounds or less, travels on three (3), four (4) or more low pressure tires, has a seat designed to be straddled by the operator and uses handlebars for steering control.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2010.
