House Bill 1143

AN ACT TO REQUIRE THAT ALL SURGICAL PROCEDURES BY PHYSICIANS OR OTHER HEALTH CARE PROVIDERS BE RECORDED WITH A VIDEO DEVICE AND THAT THE RECORDING BE MAINTAINED FOR NOT LESS THAN FOUR YEARS; TO AUTHORIZE THE PATIENT TO OBTAIN A COPY OF THE RECORDING UPON REQUEST; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  When a physician or other health care provider performs any type of surgical procedure on a patient, the physician or other health care provider or the institution in which the procedure is performed shall have the entire procedure recorded with a camera or other video device.  The physician, other health care provider or institution shall maintain the video recording of the procedure for not less than four (4) years from the date of the procedure.  The patient or the patient's representative may obtain a copy of the video recording of the procedure upon request.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2013.
