AN ACT TO AUTHORIZE THE MISSISSIPPI DEPARTMENT OF TRANSPORTATION, ACTING ON BEHALF OF THE MISSISSIPPI TRANSPORTATION COMMISSION, TO EXTINGUISH ANY CONVERSATION OR RIGHT-OF-WAY EASEMENT UPON A CERTAIN PARCEL OF LAND LOCATED IN CORINTH, ALCORN COUNTY, MISSISSIPPI, FOR THE PURPOSE OF ALLOWING AN INCUMBRANCE-FREE TRANSFER BETWEEN TWO NONPROFIT ORGANIZATIONS FOR THE PURPOSE OF ESTABLISHING A TRANSITIONAL HALF-WAY RESIDENTIAL FACILITY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Mississippi Transportation Commission is hereby authorized to extinguish, abandon and nullify any conservation or right-of-way easement in certain real property located in Corinth, Alcorn County, Mississippi, and to further assist in an incumbrance-free transfer of the affected property between two nonprofit organizations for the purpose of establishing a transitional half-way residential facility. The termination of easement granted in this subsection shall be from the residue of real property which was included in a proposed Highway Project being known and designed as Federal Aid Project No. 86-0007-01-028-10 being a segment of U.S. Highway No. 72, the property being more particularly described as follows:

Begin at the point of intersection of the Southern line of grantors property with the centerline of survey of a proposed Highway project as surveyed and staked by the Mississippi State Highway Department (said proposed Highway Project being known and designed as Federal Aid Project No. 86-0007-01-028-10 being a segment of U.S. Highway No. 72), said point of intersection is 2558.8 feet South of and 2857.6 feet East of the Northwest corner of Section 27, Township 2 South, Range 8 East; from said point of beginning run thence South 85° 15' West along said Southern property line, a distance of 239.7 feet to the present Northeastern right-of-way line of the Illinois Central Gulf Railroad; run thence Northwesterly along said present Northeastern right-of-way line of the Illinois Central Gulf Railroad as follows: run thence North 38° 51' West a distance of 225.5 feet, run thence North 51° 09' East, a distance 10.0 feet; run thence North 38° 51' West, a distance of 500.0 feet; run thence South 51° 09' West, a distance 10.0 feet; run thence North 38° 51' West, a distance of 110.4 feet; run thence Northwesterly along the circumference of a circle to the left having a radius of 11,509.16 feet, an arc distance of 72.1 feet (said arc has a chord bearing of North 39° 02' West for a distance of 72.1 feet) to the proposed Northeastern right-of-way line of the above mentioned proposed highway project; run thence Southeasterly along said proposed Northeastern right-of-way line as follows: run thence South 70° 11' East, a distance of 67.4 feet; run thence South 61° 10' East, a distance of 300.2 feet, run thence South 37° 28' East, a distance of 161.6 feet; run thence South 58° 27' East, a distance of 350.0 feet; run thence North 30° 44' East, a distance of 33.0 feet to the present Southwestern right-of-way line of U.S. Highway No. 72; run thence South 42° 15' East along said present Southwestern right-of-way line, a distance of 304.4 feet to the Southern line of grantors property; run thence South 85° 15' West along said Southern property line, a distance of 136.2 feet to the point of beginning, containing 3.86 acres, more or less, and all being

situated in a part of the Southwest ¼ of the Northeast ¼, and the Southeast ¼ of the Northwest ¼ all in Section 27, Township 2 South, Range 8 East, Alcorn County, Mississippi.

     (2)  The Department of Finance and Administration may correct any discrepancies in the legal description provided in subsection (1) of this section.

     (3)  The State of Mississippi shall retain all mineral rights in the property transferred and conveyed by mode of donation under subsection (1) of this section.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
