AN ACT

To amend chapter 67, RSMo, by adding thereto one new section relating to emergency vehicle access to certain gated communities.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 67, RSMo, is amended by adding thereto one new section, to be known as section 67.302, to read as follows:

            67.302. 1. The governing body of any county or municipality may by order or ordinance require that each electronic gate to a gated community or multiunit housing project be equipped with a gate-operating device that:

            (1) Is approved by the county fire marshal or other similar authority having jurisdiction over fire prevention; and

            (2) Will activate the electronic gate on the sounding of an emergency vehicle siren.

            2. Where such an order or ordinance is established, the fire department, fire protection district, or volunteer fire protection association which provides fire protection services for the municipality or county, or portion thereof, shall enforce the provisions of such ordinance or order.
