AN ACT
To repeal section 260.750, RSMo, and to enact in lieu thereof one new section relating to radiation monitoring.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Section 260.750, RSMo, is repealed and one new section enacted in lieu thereof, to be known as section 260.750, to read as follows:
260.750. 1. The department of natural resources shall develop an environmental radiation monitoring program for the purpose of monitoring radioactivity in air, water, soil, plant and animal life as necessary to insure the protection of the public health and safety of the environment from radiation hazards. Such monitoring shall be conducted at any solid waste disposal area as defined in section 260.200 located in a home rule city with more than ten thousand but fewer than eleven thousand nine hundred inhabitants and located in any county with a charter form of government and with more than nine hundred fifty thousand inhabitants.
2. The department of natural resources shall provide a public web portal that provides real-time data on air conditions at a minimum of four evenly distributed points along the perimeter of the landfill that shall include but is not limited to hydrogen sulfide, benzene, total volatile organic compounds (VOCs), and sulfur dioxide with the sensitivity necessary to determine if chronic exposure levels are being exceeded.
3. The department of natural resources shall conduct radiation monitoring in total counts per minute using equipment sensitive enough to detect alpha, beta, and gamma emissions.
4. There is hereby created within the state treasury an "Environmental Radiation Monitoring Fund". In addition to general revenue, the department of natural resources is authorized to accept and shall deposit in said fund all gifts, bequests, donations, or other moneys, equipment, supplies, or services from any state, interstate or federal agency, or from any institution, person, firm, or corporation, public or private as well as fees collected under subsection 2 of section 260.392. This fund shall be used for the environmental radiation monitoring program established in this section and to administer and enforce the provisions of section 260.392.
