AN ACT

To amend chapter 566, RSMo, by adding thereto one new section relating to victims of sexual offenses.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 566, RSMo, is amended by adding thereto one new section, to be known as section 566.015, to read as follows:

            566.015. 1. Whenever in this chapter criminality of conduct depends on the age of the victim or when trying to determine criminality of conduct related to an offense under this chapter and the victim has been determined to have a developmental or intellectual disability, the actual age of the victim is irrelevant, and the victim’s developmental age shall instead be considered when determining the criminality of conduct.

            2. For the purposes of this section, the developmental age shall be determined by a physician evaluation and shall take into consideration the degree of emotional, mental, anatomical, and physiological maturation of the victim.
