1.1A bill for an act
1.2relating to motor vehicles; establishing biennial inspection and filing fee charges
1.3for limited use farm trucks; making technical correction;amending Minnesota
1.4Statutes 2010, sections 168.002, by adding a subdivision; 168.33, subdivisions
1.57, 8a; 169.781, subdivision 5.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. Minnesota Statutes 2010, section 168.002, is amended by adding a
1.8subdivision to read:
1.9    Subd. 14a. Limited use farm truck. (a) "Limited use farm truck" means a farm
1.10truck that:
1.11(1) is a single-unit vehicle;
1.12(2) has a gross weight of less than 55,000 pounds;
1.13(3) is not used in the transportation of hazardous materials that are required to be
1.14placarded under Code of Federal Regulations, title 49, parts 100-185; and
1.15(4) is only operated within an area having a 50-mile radius from the farm.
1.16(b) "Limited mileage farm truck" does not include a trailer or semitrailer.

1.17    Sec. 2. Minnesota Statutes 2010, section 168.33, subdivision 7, is amended to read:
1.18    Subd. 7. Filing fees; allocations. (a) In addition to all other statutory fees and
1.19taxes, a filing fee of:
1.20(1) $4.50 is imposed on every vehicle registration renewal, excluding pro rate
1.21transactions; and
1.22(2) $8.50 is imposed on every other type of vehicle transaction, including pro rate
1.23transactions;.
1.24    except that (b) Notwithstanding paragraph (a):
2.1(1) a filing fee may not be charged for a document returned for a refund or for
2.2a correction of an error made by the Department of Public Safety, a dealer, or a deputy
2.3registrar.;
2.4(2) no filing fee or other fee may be charged for the permanent surrender of a title for
2.5a vehicle; and
2.6(3) a filing fee may only be charged every other year for the registration renewal of
2.7a limited use farm truck.
2.8(c) The filing fee must be shown as a separate item on all registration renewal notices
2.9sent out by the commissioner. No filing fee or other fee may be charged for the permanent
2.10surrender of a title for a vehicle.
2.11(b) (d) The statutory fees and taxes, and the filing fees imposed under paragraph (a)
2.12may be paid by credit card or debit card. The deputy registrar may collect a surcharge
2.13on the statutory fees, taxes, and filing fee not greater than the cost of processing a credit
2.14card or debit card transaction, in accordance with emergency rules established by the
2.15commissioner of public safety. The surcharge must be used to pay the cost of processing
2.16credit and debit card transactions.
2.17(c) (e) All of the fees collected under paragraph (a), clause (1), by the department,
2.18must be paid into the vehicle services operating account in the special revenue fund under
2.19section 299A.705. Of the fee collected under paragraph (a), clause (2), by the department,
2.20$3.50 must be paid into the general fund with the remainder deposited into the vehicle
2.21services operating account in the special revenue fund under section 299A.705.

2.22    Sec. 3. Minnesota Statutes 2010, section 168.33, subdivision 8a, is amended to read:
2.23    Subd. 8a. Electronic transmission. If the commissioner accepts electronic
2.24transmission of a motor vehicle transfer and registration by a new or used motor vehicle
2.25dealer, a deputy registrar who is equipped with electronic transmission technology and
2.26trained in its use shall receive the filing fee provided for in subdivision 7 and review the
2.27transfer of each new or used motor vehicle to determine its genuineness and regularity
2.28before issuance of a certificate of title, and shall receive and retain the filing fee under
2.29subdivision 7, paragraph (a), clause (ii) (2).
2.30EFFECTIVE DATE.This section is effective retroactively from August 1, 2005.

2.31    Sec. 4. Minnesota Statutes 2010, section 169.781, subdivision 5, is amended to read:
2.32    Subd. 5. Inspection decal; violation, penalty. (a) A person inspecting a
2.33commercial motor vehicle shall issue an inspection decal for the vehicle if each inspected
2.34component of the vehicle complies with federal motor carrier safety regulations. The decal
3.1must state that in the month specified on the decal the vehicle was inspected and each
3.2inspected component complied with federal motor carrier safety regulations. The decal is
3.3valid for (1) 12 months after the month specified on the decal or (2) 24 months after the
3.4month specified on the decal if the vehicle is a limited use farm truck, as defined in section
3.5168.002, subdivision 14a. The commissioners of public safety and transportation shall
3.6make decals available, at a fee of not more than $2 for each decal, to persons certified to
3.7perform inspections under subdivision 3, paragraph (b). Decals are issued to inspectors by
3.8serial number and are not transferable unless approved by the commissioner.
3.9    (b) A person who, with the intent to defraud, falsely makes, duplicates, alters, or
3.10forges a decal or other writing or thing purporting to be a Minnesota inspection decal
3.11described in this subdivision is guilty of a gross misdemeanor. A person who, with the
3.12intent to defraud, possesses a decal or other writing or thing falsely purporting to be a
3.13Minnesota inspection decal described in this subdivision is guilty of a gross misdemeanor.
